The rules and guidelines governing your use of the TrustGH digital trust and verification platform.
Welcome to TrustGH. TrustGH, referred to as "we," "us," or "our," is a digital trust and verification platform that allows users to verify phone numbers, businesses, and social media accounts before engaging in transactions. These Terms and Conditions, together with our Privacy Policy, govern your use of our website, mobile application, and API, which we collectively refer to as the Service. By using TrustGH, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Service.
You may use TrustGH only if you meet certain eligibility requirements. You must be at least sixteen years of age. You must be a resident of the Republic of Ghana or a business operating lawfully within Ghana. You must not be prohibited from using the Service under any Ghanaian law.
When you provide information to us, you agree to provide accurate and truthful information. Any false or misleading information provided by you may result in immediate termination of your access to the Service.
Different types of users have different registration requirements. If you are a casual user who only wants to search for phone numbers and view risk scores, you are not required to register an account.
However, if you wish to submit scam reports, you must register an account using your phone number and complete one-time password verification. If you are a business seeking verification from TrustGH, you must register an account and provide your business details along with supporting documents.
If you are a fintech or other partner wishing to use our API, you must enter into a separate written agreement with us. You are responsible for maintaining the confidentiality of your account credentials, and you are fully responsible for all activities that occur under your account.
TrustGH provides several services to the public. We offer a phone number check service where you can enter a phone number and receive a risk score ranging from zero to one hundred, along with any scam reports associated with that number and any verified business linked to that number.
We offer a business verification service where businesses can register and receive a verified badge and a unique Trust ID after their documents have been reviewed and approved.
We offer a scam reporting service where users can submit reports about suspicious phone numbers, fake WhatsApp accounts, or fraudulent mobile money requests. We offer a WhatsApp and social media check where you can paste a link and our system checks whether it is linked to a verified business or has been reported by other users.
We also offer an API for fintechs and banks, allowing them to verify numbers before processing transactions.
When using TrustGH, you must comply with our acceptable use policy. You are strictly prohibited from submitting false or malicious scam reports against any phone number, business, or individual. You are prohibited from using the Service to harass, intimidate, or threaten any person or business.
You are prohibited from attempting to manipulate risk scores or verification statuses through any means. You are prohibited from using automated bots, scripts, or scrapers to extract data from our database without our written permission.
You are prohibited from using the Service for any illegal activity under Ghanaian law, including fraud, money laundering, cyberstalking, or identity theft. You are prohibited from reverse engineering or attempting to extract our proprietary risk scoring algorithms.
Any violation of this acceptable use policy may result in immediate and permanent ban from the Service, reporting to the Cyber Security Authority, and legal prosecution under the Cybersecurity Act of 2020.
It is very important that you understand the limitations of our risk scores. The risk score provided by TrustGH is an indicator based on user-generated reports and available data. It is not a definitive determination of fraud or criminal activity.
TrustGH does not guarantee that a low risk score means a phone number is completely safe to transact with. TrustGH does not guarantee that a high risk score means a phone number is definitely fraudulent.
You must exercise your own judgment before sending any money or engaging in any transaction. TrustGH shall not be held liable for any financial loss or other damages you may suffer as a result of relying on our risk scores. The risk score is a tool to assist your decision, not a substitute for your own due diligence.
When a business receives a verified badge from TrustGH, this means the business has submitted certain documents and we have reviewed those documents. However, the verified badge does not guarantee the business's future behavior, the quality of its products, or its continued good standing.
A verified badge only indicates that at the time of verification, the business provided documentation that appeared legitimate. TrustGH reserves the right to revoke a business's verified status at any time if the business is later found to be engaged in fraudulent activity, if the business violates these Terms, or if we receive credible reports of misconduct. No verified badge is permanent.
Users of TrustGH may submit scam reports, which constitute user-generated content. When you submit a scam report, you confirm that the information you provide is true and accurate to the best of your knowledge.
By submitting a report, you grant TrustGH a perpetual, non-exclusive, royalty-free license to use, store, display, and share the report as necessary to provide our Service. We will not share your personal identifiable information beyond the phone number you are reporting.
TrustGH reserves the full right to moderate, reject, or remove any report that we deem to be false, malicious, lacking sufficient evidence, or otherwise inappropriate.
Knowingly submitting a false scam report is a serious violation of these Terms and a violation of the Cybersecurity Act of Ghana. Anyone found to have submitted false reports may be reported to the Cyber Security Authority and may face legal consequences including fines or imprisonment.
Some of our services require payment. For small businesses, business verification costs two hundred Ghana Cedis per year. For medium businesses, business verification costs five hundred Ghana Cedis per year. For large businesses, business verification costs one thousand Ghana Cedis or more per year, depending on the scope of verification required.
API access is charged per check, ranging from five pesewas to fifty pesewas per verification request. Premium user subscriptions, which include advanced insights and real-time alerts, cost between ten and thirty Ghana Cedis per month depending on the features selected. Enterprise partnerships are priced individually based on a custom quote.
All fees are denominated in Ghana Cedis and include any applicable taxes. Fees are generally non-refundable except as required by Ghanaian law. TrustGH reserves the right to change our fees at any time, and we will provide thirty days notice of any fee changes.
All intellectual property related to TrustGH is owned by us or our licensors. This includes the TrustGH name, our logo, the verified badge design, our risk scoring system, our proprietary algorithms, our website design, and our mobile application interface.
You may not copy, reproduce, distribute, modify, or create derivative works based on our intellectual property without our express written permission. You may not use our branding in any way that suggests endorsement or affiliation without our written consent.
User-generated content, such as scam reports, remains owned by the user who submitted it, but that user has granted us a license to use it as described in section eight of these Terms.
TrustGH may suspend or terminate your access to the Service at any time for any reason. Reasons for termination include, but are not limited to, violation of these Terms, submission of false scam reports, attempts to manipulate risk scores, receipt of a valid court order, or a request from the Cyber Security Authority.
You may also delete your account at any time by contacting our support team at support@trustgh.com. Upon termination, your access to the Service will be immediately revoked, but we may retain certain data as required by our data retention policy described in our Privacy Policy.
To the maximum extent permitted by the laws of the Republic of Ghana, TrustGH shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or your inability to use the Service.
This includes, without limitation, financial loss resulting from fraud, loss of business, loss of reputation, or any other damages. Our total liability to you for any claim arising out of or relating to these Terms or your use of the Service shall not exceed the amount you have paid to us, if any, in the six months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so this limitation may not apply to you in full.
You agree to indemnify, defend, and hold harmless TrustGH, its founders, employees, officers, agents, and partners from and against any and all claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or relating to your violation of these Terms, your submission of false or malicious scam reports, your misuse of the Service, or your violation of any applicable law or regulation.
This indemnification obligation will survive the termination of your account and your use of the Service.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana, without regard to its conflict of law principles.
Any dispute arising out of or relating to these Terms or your use of the Service shall first be attempted to be resolved through good faith mediation. If mediation fails to resolve the dispute within thirty days, the dispute shall be submitted to the exclusive jurisdiction of the High Court of Ghana sitting in Accra. You agree to submit to the personal jurisdiction of that court for the purpose of litigating any such dispute.
TrustGH may update these Terms and Conditions from time to time. When we make changes, we will notify you by email if you have an account with us, through an in-app notification, or through a banner on our web application. The effective date at the top of these Terms will be updated accordingly.
Your continued use of TrustGH after any changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall continue in full force and effect.
The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely achieves the original intent.
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision. Any waiver of any provision of these Terms shall be effective only if in writing and signed by an authorized representative of TrustGH.
A waiver of any provision on one occasion shall not be construed as a waiver of that provision on any future occasion.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TrustGH regarding your use of the Service. They supersede all prior agreements, understandings, or representations, whether written or oral, relating to the subject matter of these Terms.
You acknowledge that you have not relied on any representation not expressly included in these Terms.
